Terms of Service
These Terms of Service ("Terms") govern your use of the Aegis mobile application ("the App"), provided by Nexrara ("we", "us", "our"). By creating an account or using the App, you agree to these Terms. If you don't agree, please don't use the App.
1. The App is a study aid — not medical, legal, or licensure advice
Aegis is a personal study tool for the NCLEX-RN nursing licensure exam. It is not a substitute for:
- accredited NCLEX preparation programs,
- your nursing school's curriculum,
- official NCSBN study materials, or
- licensed medical, legal, or professional advice.
Always verify clinical content against official NCSBN resources and your textbooks before applying it in nursing practice or relying on it for licensure decisions. We make no guarantees about exam outcomes.
2. NCLEX is a registered trademark
NCLEX® is a registered trademark of the National Council of State Boards of Nursing, Inc. (NCSBN). Nexrara and Aegis are not affiliated with, endorsed by, sponsored by, or approved by NCSBN. We reference the NCLEX-RN exam only descriptively, to identify what the App helps you prepare for.
3. Your account
To use the App, you must:
- be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher);
- provide accurate registration information;
- keep your password secret;
- be responsible for activity on your account.
Notify us at support@nexrara.com if you suspect unauthorized access.
You may delete your account anytime in Settings → Danger zone → Delete account. Deletion is permanent.
4. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial study.
You may not:
- copy, modify, reverse-engineer, or create derivative works of the App;
- scrape, bulk-export, redistribute, or republish the App's question content or rationales;
- use the App to develop a competing product;
- use the App in any way that violates law or these Terms.
The App, including all questions, rationales, case studies, and design, is owned by Nexrara and protected by copyright and other intellectual property laws.
5. Content accuracy
We work to keep clinical content accurate and aligned with the current NCSBN test plan, but we cannot guarantee that every question, rationale, or explanation is error-free or current. You are responsible for verifying clinical information against authoritative sources before relying on it.
If you find a question that appears incorrect, please report it via the App or email support@nexrara.com. We'll review and update as needed.
6. Privacy
Our Privacy Policy explains what data we collect and how we use it. It is part of these Terms.
7. Subscriptions and payments
The App is currently free to use. If we introduce paid features in the future, those will be governed by additional terms presented at the time of purchase, and all transactions will go through Apple's App Store, subject to Apple's Media Services terms.
8. Termination
We may suspend or terminate your account if you:
- materially violate these Terms, or
- use the App in a way that harms us, our users, or third parties.
You may stop using the App and delete your account anytime. After termination, your data is removed per the deletion process described in the Privacy Policy.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL HELP YOU PASS THE NCLEX.
We do not warrant that the App's content reflects the latest NCSBN specifications at all times. Exam content evolves; we update on a best-effort basis.
10. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, NEXRARA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- your use of (or inability to use) the App;
- any reliance you place on information in the App;
- the outcome of your NCLEX exam or licensure attempt;
- any unauthorized access to or use of our servers and/or any personal information stored therein.
Our total liability for any claim arising out of or relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) US $10.
11. Apple-specific terms
You acknowledge that these Terms are between you and Nexrara, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
12. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Travis County, Texas, and you consent to that venue.
If you live in the European Union, the United Kingdom, or another jurisdiction that grants you rights to bring a claim in your local courts, nothing in this section waives those rights.
13. Changes to these Terms
We may update these Terms. The "Last updated" date at the top reflects the most recent change. Material changes will be highlighted in-app on next launch. Continued use of the App after changes take effect means you accept the updated Terms.
